Christian Louboutin vs. YSL (Yves Saint Laurent)

 

There you have it folks…. “One cannot own a color.”

Last week, Judge Victor Marrero;  issued his final ruling in  the case of the “red sole bottoms.”  Here’s what the judge said:

Designers are artists and that no artist should be denied any hue from the rainbow when they are creating. Both art and fashion are about creative freedom and fair competition.”

The judge also noted that in the fashion industry a color serves as an esthetic rather than a useful purpose, and therefore could not accuse YSL of copyright infringement despite Christian Louboutins’ public recognition of the red sole bottoms shoe in the fashion industry.

There are mixed feelings in the fashion industry on this verdict, but one thing for certain is that this decision now warrants other designers other than YSL to design red soled shoes.  Is this a good thing or bad thing? Speak on it people?
